Our platform offers a subscription giving access to a catalog of eBooks containing destination guides, cost-saving strategies, and travel resources (the "Service"). Airport services (Fast Track, Automated Check-In, Meet & Greet, Business Lounge, Activities) are not part of the Service: they are booked and paid for individually, whether or not you hold a Service subscription, as described in Article 4.1. The purpose of the following terms is to outline how you, as a Client, can utilize the Service in accordance with applicable laws and regulations ("Terms").

Please note that our Terms may be subject to occasional adjustments and additions to adapt to changing circumstances. In such cases, we will notify you by email one month before these updates take effect. Your continued use of our Service after receiving this notification, as well as your failure to terminate your subscription at the end of the month, signifies your agreement with the most recent version of these Terms.

1. Registration

1.1 Upon accepting our trial offer, you will be automatically registered for our Service. Your login credentials, including your email address (which will serve as your username) and a system-generated password, will be sent to you via email for your convenience.

1.2 As a Client, you are responsible for ensuring the accuracy of the email address provided during registration. It is essential that the provided email address is current and valid. By using our Service, you confirm that you are of legal age and eligible to use our Service in your country of residence. We want to emphasize that we retain the right to take legal action against you, including criminal prosecution, in cases of identity theft.

1.3 Your subscription contract becomes effective upon your receipt of the registration email with login credentials, as described in Article 2 below ("Contract"). You can download your Contract at any time by requesting it via email.

1.4 It is your responsibility as a Client to keep your login credentials, including the provided password, confidential and to report any unauthorized use. Transmitting your access to third parties without our prior consent is strictly prohibited.

2. Payment

2.1 The cost of using the Service is as follows: clients who choose to add the Service while purchasing a personalized travel service receive a 24-hour trial of the Service free of charge from that moment. After these initial 24 hours, unless terminated within that timeframe, a subscription is automatically initiated on a monthly basis for a monthly fee of 39.9 €. Unless canceled, this subscription is automatically renewed on a month-to-month basis, and the designated card is automatically charged.

2.2 The listed prices include all applicable taxes.

2.3 Payments are processed through our Site in euros via credit cards (Visa, MasterCard, American Express). The Site is equipped with an online payment security system that allows you to encrypt the transmission of your banking information. We use an external payment processor as part of our payment process, and we do not retain any information related to your personal details and credit cards. For more details on this matter, we encourage you to review our privacy policy.

3. Returns and Refunds Policy

3.1 Before your subscription is finalized, you will be asked, as a distinct checkout step, to expressly consent to us providing immediate access to the eBook catalog before the end of the 14-day withdrawal period described in Article 3.3, and to separately acknowledge that giving this consent means you lose your right to withdraw once that access has been given. This consent is logged with a timestamp at checkout.

3.2 If you have not given the consent described in Article 3.1, or if you request a refund before accessing the Service, we will reimburse the amount you paid within 5 (five) to 10 (ten) days after we receive your refund request. The refund will be credited to the card you used for the Service payment. Where you have given the consent described in Article 3.1 and accessed the Service, your withdrawal right for that access is lost as described above, and any withdrawal request received afterwards will be treated as a termination notice effective at the end of the respective month rather than as a refund request.

3.3 Customers have a legal right to withdraw from the purchase within 14 days without providing any reason. The withdrawal period starts from the day of purchase. This right is only lost early, for digital content such as the eBook catalog, through the express two-part consent described in Article 3.1, not through use of the Service alone.

4. Service Operation

4.1 Once your subscription agreement is finalized you will gain access to our full eBook Catalog containing destination guides, cost-saving strategies, travel planning resources, and exclusive content delivered monthly to your account. Fast Track, Automated Check-In, Meet & Greet, Business Lounge and Activities booking are separate services: they can be booked and paid for individually via the Site by any customer, whether or not they hold an eBook subscription, and they are fulfilled by our airport service partners, who are the direct contracting party for that specific service booking, not PassFly.

4.2 Please note that we cannot guarantee that additional booking service providers will accept, approve, or fulfill your request. In the event that a request is declined or cannot be processed for any reason, the amount paid for the booked service will be automatically refunded.

4.3 It is prohibited to:

  • Employ the Site unlawfully or in violation of the current Terms.
  • Engage in the sale, replication, rental, lending, distribution, transfer, or sublicensing of any or all of the content available on the Site, our Service, or use our Service for commercial purposes.
  • Attempt unauthorized access to our systems or those of our subcontractors, or partake in activities that could disrupt, degrade quality, or interfere with the performance or functionality of the Site and our Service.
  • Employ the Site for abusive purposes by introducing viruses or any other malicious programs intentionally.
  • Use our Service for spamming or any form of harassment.
  • Disparage our activities or engage in any conduct that could harm our reputation, whether through our Service or elsewhere (e.g., on social networks).

5. Termination

5.1 Termination Initiated by the Client: You have the option to unsubscribe and cancel your Contract at any time by simply clicking the "Unsubscribe" link located at https://passfly.co/unsubscribe in the website menu at either the top or bottom of the page. It's important to note that your unsubscription will take place either at the end of the Trial Period or at the end of the current month, depending on when you request the unsubscription. If your account is deactivated, you will no longer have access to or be able to use the services of WIZORG LTD. With the exception of article 3.3, no refunds will be issued.

5.2 Termination Initiated by WIZORG LTD: We also retain the right to end your Contract with one month's notice. We will inform you of this through an email sent to the address you provided during your registration. In the case of a breach of these Conditions, particularly as outlined in article 4.3, we have the right to suspend your account for as long as necessary to carry out verifications, and if required, to terminate your Contract immediately. Whether it's a suspension or termination, you will be notified via an advance notice sent to the same email address.

5.3 Termination carried out as per this article does not entitle you to a refund, unless this termination is considered equivalent to exercising your right of withdrawal as outlined in articles 3.1 and 3.3.

6. Intellectual Property

6.1 WIZORG LTD holds all intellectual property rights related to https://passfly.co and its content, including any associated know-how.

6.2 Upon the conclusion of the Contract, we grant you a non-exclusive, non-transferable right to access and use the services.

7. Liability and Guarantee

7.1 WIZORG LTD is not liable for indirect, consequential, or special losses, or for matters outside its reasonable control, arising from the execution of the Contract. Nothing in these Terms excludes or limits WIZORG LTD's liability for death or personal injury caused by negligence, for fraud, or for failing to perform the Service with reasonable care and skill, to the extent such liability cannot lawfully be excluded under the Consumer Rights Act 2015.

7.2 Regardless of article 7.1, WIZORG LTD will make reasonable efforts to maintain the availability of https://passfly.co 24/7, but we cannot be held accountable for any unavailability due to bugs, technical constraints, or maintenance activities, and no refunds will be provided in such cases.

7.3 https://passfly.co may contain links to other sites not managed or controlled by WIZORG LTD, and as such, we cannot be held responsible for their functionality or content.

7.4 Limitation of Liability:The Service provides eBook content to assist the Client. While we make every effort to ensure the accuracy, completeness, and reliability of the Service, we do not guarantee any specific outcome or result from its use. The User is solely responsible for verifying any information and for decisions made based on the Service. Subject always to Article 7.1, and to the maximum extent permitted by law, any liability of the Company for the Service is limited to the amount paid by the User for the Service, and the Company shall not be liable for any indirect, incidental, consequential, or special damages, including any loss of opportunity, loss of revenue, or other financial loss, arising from use of the Service.

8. Miscellaneous

8.1 Force Majeure: Both parties agree that in cases where execution of the Contract becomes impossible due to a force majeure event, neither party can be held responsible for the non-performance, shortcomings, or delays in fulfilling their obligations. The Contract execution and associated obligations, including payment, will be suspended for the duration of the force majeure event. However, payments made for the ongoing month during which the force majeure event occurred will be retained. Each party maintains the right to exercise the termination option as outlined in article 5.

8.2 Null and Void: If any provision of these Conditions is declared null and void, it will not affect the validity of the remaining Conditions. The null clause will be replaced and interpreted in a manner that ensures its validity, as closely as possible to the spirit of the nullified clause.

8.4 Consumer Mediation: In accordance with the Consumer Code provisions relating to the consumer dispute mediation process, after contacting us and if the response provided does not satisfy you, you may use a consumer mediation procedure free of charge through:

8.5 Applicable Law and Competent Court: The validity and enforcement of these Conditions and the Contract are subject to English law. If WIZORG LTD brings a claim against the Client, it will do so in the courts of the Client's domicile. If the Client brings a claim against WIZORG LTD, the Client may choose to do so either in the courts of their own domicile or in the courts of England. Nothing in this Article removes any right the Client has under applicable consumer protection law to bring or defend proceedings in their own domicile courts.
